Steps towards Resolution

This discussion is free of charge and without further obligation.

Before mediation can begin, each person will have a private, confidential session with the Family Dispute Resolution Practitioner (FDRP). This can be done in person, over the phone, or via video call (Zoom).

In this conversation, the FDRP will explore whether mediation is the right path forward.

If mediation isn’t suitable, the FDRP won’t share the reasons with the other party, in line with strict confidentiality.

If the case is appropriate for mediation, both parties will be guided through the next steps, clarifying the issues to be discussed (such as parenting or financial matters) and identifying any documents or information needed.

 

Once you're ready to move forward, a joint session is arranged where both parties come together with the Family Dispute Resolution Practitioner (FDRP). The FDRP guides the conversation to ensure each person is heard, positions are clarified, and potential solutions are explored in a respectful and balanced way.

Mediation can take place via Zoom (an option many clients appreciate for its convenience) or in person at our meeting rooms in Cronulla or Sydney CBD.

The first step is identifying the key issues to resolve. These may include:

• Parenting arrangements (e.g., time with children, holidays)

• Concerns around children or assets

• Financial and property matters

When parenting is involved, the focus remains firmly on what’s best for the children.

Throughout the session, the FDRP supports both parties in exploring practical options (whether that’s around child care, finances, or shared responsibilities) and helps narrow down solutions that meet everyone’s needs.

 

The goal is a respectful, balanced negotiation that leads to a workable agreement, giving both parties a voice and keeping the best interests of the children at heart.

If an agreement is reached during mediation, the FDRP will assist in putting it in writing. This may take the form of a Parenting Plan or a property settlement agreement, depending on the issues discussed. While these documents aren’t legally binding on their own, they can form the foundation for:

• Consent Orders (filed with the court)

• Binding Financial Agreements (for property and financial matters)

 

If mediation doesn’t go ahead or an agreement isn’t reached (and parenting matters are involved) the FDRP can issue a Section 60I Certificate. This is required if either party wishes to apply to the Federal Circuit and Family Court of Australia for parenting orders.

 

We always encourage participants to seek independent legal advice before signing any agreement. Legal professionals can also help formalise your agreement into a binding document if needed.
