Find a Better Resolution and Avoid Court
Mediation is an alternative dispute resolution process where a mediator, a neutral third party, assists individuals in conflict to negotiate and reach a agreement both parties can live with. The parties involved maintain control over the resolution's outcome throughout the process.
Our mediators facilitate constructive communication, encourage understanding and guide the parties by identifying their own interests and needs. Through collaborative problem-solving methods, the parties work toward creating their own agreement.
Unlike arbitration or court proceedings, the mediator does not impose any decision upon the parties. Mediation empowers parties by providing greater control over how their dispute is viewed, managed and resolved.

Mediation provides the space for parties to think of more flexible and creative solutions than those available in courts, tribunals or other extended negotiations.
Advantages of Mediation
-
Decisions remain within your control and the other party/parties involved.

-
You may discuss other non-legal issues that may not be considered in a court.

-
You may have a support person present at the mediation. This will need to be disclosed prior to the session.

-
You may choose to have your agreement documented and legally binding.

-
The mediator is neutral; however, they will treat you and all parties involved with empathy and respect.

-
The process ensures privacy and confidentiality in handling your matter.

-
Your mediator will do their best to make sure that you are prepared for and feel comfortable throughout the session.

-
Rest assured that any agreement made will reflect your own and the other party's best interests.
Lawyers and Other Support People
Before starting mediation, it is always recommended to seek independent legal advice on your rights, obligations and options available to you.
With consent, of all parties, mediation can also include support people such as your lawyer, family member or someone else relevant to the matter.
In cases involving individuals, like neighborhood disputes, mediation typically works best without active lawyer participation, though lawyers may attend to provide advice and observe.
For more complex and/or legal matters having lawyers involved is common. The mediator, however, will ensure that all parties to the dispute have a chance to speak and encourage them to do so to promote direct communication.
